Do You Need to Prove Grounds for Divorce in New York State?
Prior to October 2010, yes. Grounds for divorce initially only included constructive or physical abandonment, cruel or inhuman treatment, adultery, or imprisonment for over 3 years. Now, the legislature amended the law to include another ground for divorce called irretrievable breakdown of the marriage spanning a six-month time period, which is essentially a no-fault ground.
