Grounds For Divorce
In the state of New York, most couples seeking divorce do so on the grounds that their marriages have suffered an irretrievable breakdown, which is more commonly known as a “no-fault” divorce.
For the court to grant your no-fault divorce, you must be able to meet three requirements:
- You or your spouse must declare under oath that your relationship has been irretrievably broken for at least six months.
- You and your spouse must resolve all other important divorce-related issues, including child custody and visitation, spousal maintenance, property division, and child support or the court must decide these issues for you.
- You or your spouse must meet the residency requirements for filing a divorce in New York.
Even though no-fault divorces are the most common of divorces, it is important to mention that several other grounds continue to exist under New York law. These grounds include the following:
- Cruel and inhuman treatment
- Irretrievable breakdown in relationship for a period of at least 6 months
- Abandonment
- Imprisonment
- Adultery
- Divorce after a legal separation agreement
- Divorce after a judgment of separation
Each of these grounds have their own specific requirements for both the Plaintiff and the Defendant. Additionally, each of these grounds have their own guidelines for what constitutes some of these grounds and terms including abandonment, adultery, and separation. It is very important to discuss these requirements and guidelines with a legal professional and a New York state judge during the legal process.
