Grounds For Divorce In New York

In New York, most couples seeking divorce do so on the grounds that their marriages have suffered an irretrievable breakdown, which is more commonly known as a “no-fault” divorce.

For the court to grant your no-fault divorce, you must be able to meet three requirements:

  • You or your spouse must declare under oath that your relationship has been irretrievably broken for at least six months.
  • You and your spouse must resolve all other important divorce-related issues, including child custody and visitation, spousal maintenance, property division, and child support or the court must decide these issues for you.
  • You or your spouse must meet the residency requirements for filing a divorce in New York.
